Information Collection:

We collect non-personally identifiable information (non-PII) and personally-identifying information (PII) from our customers and visitors to our Web site and from users of our downloadable applications. We only collect PII when a customer explicitly chooses to provide it, as when registering with GlobalMojo and emailing GlobalMojo through our online contact form.

Collection and Use of Personal Information (PII):

We collect and store Personal Information when you register to become a GlobalMojo user, ask a question, complete a form, or send us an email. We use your personal information to provide you with a customized web profile, validate your identity, improve our products, notify you of important updates, respond to your requests, and to fulfill legal and regulatory obligations. The products and preferences you have set up in your GlobalMojo account will be used for internal market research activities as deemed necessary by GlobalMojo.

Your PII information will not be supplemented from any other source. None of your personal information is ever shared with any third party without your permission.

Contact Us Form:

When you use the Contact Us form on http://GlobalMojo.com/about/contactus, we collect your email and browser information in order to answer your question appropriately. We do not store this information and only use it to respond to your question or provide you with technical support.

Registration:

During the registration process, you have the option to register with Facebook or to create your own profile. It's important that we can track the revenue earned by each user back to the actual person who earned it to ensure the revenue you generate is distributed to the causes you support.

• Create a Profile: If you elect to create your own account, we ask you for your email address, username and password to maintain total transparency.
• Facebook Connect: You can log in to our site using the Facebook Connect sign-in service. This service will authenticate your identity and give you the option to communicate with us about the GlobalMojo application and post information about your activities on this web site to your profile page to share with others on your network. Facebook provides us with your basic information, such as your username, profile picture, gender, user ID, list of friends, as well as your email. Should you choose not to provide your email, you will be allowed to change it to an anonymous email address.

Invite Friends functionality:

We use Facebook, Twitter, MySpace, LinkedIn, AddThis, and ShareThis to provide “Invite a Friend” services. These services will authenticate your identity and give you the opportunity to invite your friends and contacts to use GlobalMojo. We do not have access to or control over PII submitted to these services. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your personally identifiable information by such third parties, and we cannot guarantee that they will adhere to the same privacy practices as GlobalMojo. We encourage you to review the privacy statements of any other service provider from whom you request services. If you visit a third party website that is linked to a GlobalMojo site, you should read that site's privacy statement before providing any personally identifiable information.

Age Restrictions on GlobalMojo User:

In compliance with the Children's Online Privacy Protection Act (COPPA), we do not allow the use of our products or collect PII from any persons under the age of 18. We take measures to prevent the distribution of our software on websites targeting children under 18 by preventing our distribution partners, affiliates, and private label partnerships from such distribution. We engage in commercially reasonable oversight in determining where advertisements promoting the installation of our certified software appear. Additionally, we take measures to remove our content from individuals under the age of 18 and remove any stored information about the person from our database.

Updating Your Personal Information:

A user may access their personally identifiable information through a secure login on our website. If your personally identifiable information changes, you may correct or make updates in the "My Profile" section of our website. Collection and Use of Information by GlobalMojo's Website (non-PII):

Some of the information GlobalMojo receives about your visit to www.GlobalMojo.com may be used for our internal research and to help us improve the site and the services GlobalMojo offers to its customers. In general, the Internet addresses of computers, also known as IP addresses, are logged to track user sessions on an anonymous basis. GlobalMojo analyzes this data for certain trends and statistics, such as which parts of our site users are visiting, how long they spend there, browser type and server load. The IP address tracking is done in the aggregate form and we do not link this information to personally identifiable information. This information is collected automatically by almost all major web servers.

We may use the non-PII information list above for the following purposes:

• Fulfill your requests for products and services;
• Manage your user account and preferences;
• Analyze use of and improve our website, products and services;
• Facilitate use of our website;
• Offer promotions and updates from our partners that may be of interest to you;

Collection and Use of Information by GlobalMojo Browser App(PII):

In order to use the GlobalMojo App, (Product), you may be asked to provide certain information, such as personal information (including your email address, username and password) at the point of registration. You voluntarily provide all such information. GlobalMojo does not utilize such information for the purpose of displaying advertisements or profiling and does not sell, rent or lease such information to third parties.

Our Product automatically collects information from you to enable the Product's services. By installing the Product, you authorize GlobalMojo to periodically collect certain information such as portions of Web site addresses or complete URLs from the Web sites you visit and upload this information to our servers so that we may improve your GlobalMojo experience. The Product does not collect, store, or use PII, and GlobalMojo does not receive PII, as a result of your use of this Software.

Collection of PII from Third Party Affiliates:

We engage in business relations with third party companies and affiliate providers and offer unique services to members of such companies within a private label environment. In turn, some pages of our website may contain both the GlobalMojo brand and the third party brand. The Third Party may not use the personalized services to collect any PII and is prohibited from doing so. This Privacy Policy applies to all of the pages in the personalized environment.

If you entered our website or downloaded our app by clicking an affiliated link or promotion from another site we will store the ID of that affiliate site in our database. We do this to make sure that the affiliate site receives proper credit for any subsequent earnings that may come from your use of GlobalMojo products.

We reserve the right to share your PII as required by law and when we believe that it is necessary to protect the rights of our company and/or comply with a legal guidelines, court mandates, or legal process served on our website.

We also allow users to register for our product using Facebook Connect. We treat information obtained from such sources as we would information obtained from a registration form. We will not use the information submitted by the user for any purpose outside of those previously stated in the privacy agreement.

Cookies:

When you download the GlobalMojo browser app we send a small file to your computer that uniquely identifies your browser app. This file is called a cookie. We use this cookie to identify you as a GlobalMojo user and it facilitates the display of the preferences, settings and customization options that you have selected for your GlobalMojo product(s). Your browser is probably set up by default to accept cookies, including GlobalMojo cookies, but you can reset your browser to refuse all cookies or to alert you when a cookie is being sent to your computer. You should be aware, however, that some of GlobalMojo's features may not function properly if you disable cookies on your computer.

Information Security:

To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, GlobalMojo has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure all personal information that GlobalMojo collects online. These security measures include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store your personal data.

In addition, we restrict access to personal information only to GlobalMojo employees and contractors who need to know that information in order to operate, develop or improve our services. These parties are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. Unfortunately, no security system can be 100% secure. With that said, GlobalMojo cannot guarantee the security of any information provided to us in connection with the information that we collect through our website and browser app.

GlobalMojo products contain links to other websites. This Privacy Policy applies solely to GlobalMojo products and website. GlobalMojo makes no representations or warranties about, nor is it responsible for, the Privacy practices of other websites. When you enter a linked website (via our products or site), GlobalMojo encourages you to read the Privacy Policy of that linked website, as its Privacy Policy may differ substantially from that of www.GlobalMojo.com.

Changes to GlobalMojo's Privacy Policy:

By using GlobalMojo products and our web site, you consent to the collection and use of your information as we have outlined in this Policy and to GlobalMojo's user agreement. GlobalMojo may decide to change this Privacy Policy from time to time. When we do, we will send you a notification of the material change upon installation of update via email or other obvious method, such as posting the notice to your account dashboard. In addition, we will post those changes on this page so that you are always aware of the information we collect, how we use it, and under what circumstances we disclose it. If you do not wish your information to be used under the new Policy, you can request that your account and all associated data be deleted at any time. You can also uninstall our products at any time using standard uninstall methods.

GlobalMojo GIVING ASSISTANT END-USER LICENSE AGREEMENT

NOTICE TO USER: THIS END USER LICENSE AGREEMENT ("AGREEMENT") APPLIES WITH RESPECT TO SOFTWARE APPLICATIONS AND DIGITAL CONTENT (" GlobalMojo PRODUCT") OWNED AND PROVIDED BY GlobalMojo INC. (REFERRED TO IN THIS AGREEMENT AS "WE" OR " GlobalMojo") FROM ANY GlobalMojo WEB SITE. THIS AGREEMENT SETS FORTH YOUR RIGHTS AND OBLIGATIONS WITH RESPECT TO YOUR USE OF ANY GlobalMojo PRODUCT (DEFINED IN SECTION 1 BELOW.) PLEASE READ THIS AGREEMENT CAREFULLY. BY CLICKING "ACCEPT," "INSTALL," "FINISH," OR A SIMILAR ACKNOWLEDGMENT BELOW OR BY USING THE PRODUCT, YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU AGREE THAT THIS AGREEMENT IS ENFORCEABLE LIKE ANY WRITTEN NEGOTIATED AGREEMENT SIGNED BY YOU. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE GlobalMojo PRODUCTS.

Notice for All Users:

By installing the GlobalMojo Giving Assistant product, you get to leverage GlobalMojo's merchant relationships to generate money for the causes that matter to you just by doing what you do every day on the web. We give away 50% of the gross revenue generated from our online merchant partnerships when you search, shop, and book travel online. The merchants pay us a fee and we pass a portion of that to the causes that matter most to our users.

The GlobalMojo product is free. There is never an extra cost to you. All of the products and services available through our partner websites cost exactly the same as it does without having the GlobalMojo product installed on your browser.

The product is 100% safe. It does not store or transfer any personally identifiable information and the GlobalMojo product is not bundled with any third party software. It's also easy to disable or remove the GlobalMojo product entirely from your computer if you choose to do so. Instructions on how to do this can be found in this document.

1. Definitions.

   " GlobalMojo Product" means (a) the GlobalMojo website, GlobalMojo downloadable browser applications (Giving Assistant), any other digital content owned and provided by GlobalMojo, that accompanies this Agreement; and (b) any bug fixes, upgrades, modified versions, or updates to the GlobalMojo Product (collectively referred to as "Updates") we subsequently provide to you.

2. Owner of Computer; All Users Bound; Age Limitation; Software License.

   You represent and warrant either that you are the owner of the computer and that you have authorized the download and installation of the GlobalMojo Product or that the owner of the computer has authorized you to do so. You agree, with respect to all users of the computer on which you have caused the GlobalMojo Product to reside, to provide a copy of these terms and conditions and to obtain their consent to these terms and conditions before allowing them to Use the GlobalMojo Product. Alternatively, if you have the legal right to accept this Agreement on behalf of one or more users of the computer on which you have caused or authorized the GlobalMojo Product to reside, then you hereby accept this Agreement on behalf of all such other users. You understand that the presence of the GlobalMojo Product on any computer is voluntary and that you may remove it at any time. You must be at least 18 years of age to Use the GlobalMojo Product. By accepting the terms of this Agreement and Using the GlobalMojo Product, you represent that you are over the age of 18. As long as you comply with, and subject to, the terms of this Agreement, GlobalMojo grants to you a non-exclusive, revocable license to Use the GlobalMojo Product, in binary executable form only, solely for the purposes described in this Agreement.

3. Restrictions.

   You may not rent, lease, loan, resell or otherwise transfer the Product. You may not permit third parties to benefit from the use or functionality of the Product. You may not transfer any of the rights granted to you under this Agreement. You may not reverse engineer, decompile, disassemble the Product, or otherwise attempt to discover the source code or structure, sequence and organization of any portion of the Product that is not distributed in source code form (except to the extent applicable law prohibits such restrictions). You may not modify, or create derivative works based in whole or in part upon, the Product. You may not copy the Product. You may not remove any proprietary notices or labels on the Product. All rights not expressly set forth hereunder are reserved by the GlobalMojo corporation.

4. Intellectual Property Rights.

   GlobalMojo and its licensors shall retain all intellectual property rights in the Product, except for the rights expressly granted in this Agreement. You may not alter or remove any logo, or trademark (collectively, "Marks"), copyright or other proprietary notice(s) on the Product. This license does not grant you any right to use Marks of GlobalMojo or its licensors.

5. Breach of Agreement:

   Upon breach of this Agreement, the above license and your right to use the Product will terminate immediately and without notice, but all other provisions and terms of this Agreement, except the license grant, will survive termination and continue in effect. Upon termination, you must destroy all copies of the Product. GlobalMojo reserves the right to periodically conduct audits upon advance written notice to verify compliance with the terms of this Agreement.

6. Use of Product:

   You represent, warrant and agree as a condition to your use of the Product, that you will not use the Product: (i) to violate any applicable law, statute, ordinance or regulation; (ii) to infringe the intellectual property rights or proprietary rights, or rights of publicity or privacy, of any third party; (iii) to disseminate information or materials in any form or format ("Content") that are harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise objectionable under applicable laws or community standards. You, not GlobalMojo, remain solely responsible for all Content that you upload, post, e-mail, transmit, or otherwise disseminate using, or in connection with, the Product. You acknowledge that all Content that you access using the Product is at your own risk and you will be solely responsible for any damage to any party resulting there from. THIS PRODUCT IS PROVIDED "AS IS" AND WITHOUT WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS SO THE FOREGOING LIMITATIONS MAY NOT APPLY TO YOU.

7. Use of Information.

   By installing the GlobalMojo Product you grant permission for GlobalMojo to collect and use certain information. You acknowledge that you have reviewed GlobalMojo's Privacy Policy for the GlobalMojo Product, which describes GlobalMojo's practices with respect to the collection, use and disclosure of information in connection with your Use of the GlobalMojo Product. A copy of the Privacy Policy is available at http://globalmojo.com/about/legalstuff. GlobalMojo reserves the right to change the provisions of its Privacy Policy from time to time. Users will be notified of any changes to the Privacy Policy via a Primary Notice notification. In addition, GlobalMojo will alert users via email or a notification prominently displayed on their account dashboard when there is a change to the Privacy Policy. Additionally, GlobalMojo will post any changes to the Privacy Policy at the web address listed above. Your use of the GlobalMojo Product following the posting of such changes to the Privacy Policy will constitute your acceptance of any such changes.

8. Links to Third Party Sites; Advertisers.

   The GlobalMojo website and GlobalMojo Product will provide you with access to other partner websites, services, products or content of third parties. We have no control over, nor do we endorse any such websites, services, products or content. You acknowledge and agree that you access such third party websites, services, products, or content at your own risk and are wholly responsible for making your own independent judgment regarding your use or interaction with the same. We recommend you read the privacy and terms of use policies of each third party's website that you access.

9. United States Government End Users.

   If the user or licensee of this Product is an agency, department, or other entity of any Government, the use, duplication, reproduction, release, modification, disclosure, or transfer of this Product, or any related documentation of any kind, including technical data, software, and manuals, is restricted by the terms of this Agreement. All other use is prohibited. No rights other than those provided in Agreement are conferred. This product was developed fully at private expense.

10. Updates.

    GlobalMojo, in its sole discretion, may provide you with Updates to the GlobalMojo Product as part of this Agreement. The GlobalMojo Product will automatically check GlobalMojo for the existence of any Update that GlobalMojo has released, and in the event that one is available, GlobalMojo adheres to the native plugin update features available from each browser plugin (Internet Explorer, Safari, Chrome and Firefox.) Nothing herein shall be construed or interpreted as requiring that GlobalMojo provide Updates. When browser functionality allows (Internet Explorer), GlobalMojo will not install any new software or Update that in our reasonable judgment has functionality that is materially different from the functionality of the previously installed GlobalMojo Product without your prior consent. In the case of a browser controlled Update that does not allow GlobalMojo to notify you prior to installing the update (Firefox, Chrome, and Safari), GlobalMojo will provide a detailed notice of Update and necessary uninstall instructions immediately upon installation.

11. Uninstallation.

    You understand and agree that the presence of the GlobalMojo Product on your computer is voluntary and that you may remove the GlobalMojo Product from your computer at any time. To uninstall the GlobalMojo Product, follow the instructions below:

12. Compatibility.

    GlobalMojo does not warrant that the GlobalMojo Product will be compatible with your hardware or other software installed on your computer system. Compatibility issues may cause your computer's performance to suffer. In the event that the GlobalMojo Product is not compatible with your hardware or other software installed on your computer system, the GlobalMojo Product can be uninstalled. Please refer to the previous section for detailed uninstall directions. Like all software, the GlobalMojo Product utilizes some of your computer's resources to run, including system memory and Internet connection. Use of the GlobalMojo Product on a computer with inadequate system resources will cause such computer's performance to suffer.

13. User Representations and Warranties.

    You acknowledge, represent and warrant that (a) your installation and/or Use of the GlobalMojo Product will not violate any local, state or federal laws that apply to you or to the Use or installation of the GlobalMojo Product; and (b) GlobalMojo is not causing the GlobalMojo Product to be installed on your computer, but has provided the GlobalMojo Product to you, which you are installing of your own volition.

14. Indemnification.

    You agree to defend, indemnify, and hold harmless GlobalMojo, its licensors and suppliers, and each of their respective officers, directors and employees, from and against any lawsuits, claims, losses, damages, fines and expenses (including attorneys' fees and costs) arising out of your use of the GlobalMojo Product or your breach of this Agreement.

15. Liability:

    NOTWITHSTANDING ANYTHING TO THE CONTRARY, NEITHER GlobalMojo NOR ITS LICENSORS WILL BE LIABLE, UNDER ANY LEGAL OR EQUITABLE THEORY (WHETHER IN AN ACTION BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE), FOR (I) ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PRODUCT OR OTHER SUBJECT MATTER OF THIS AGREEMENT (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA AND COMPUTER MALFUNCTION), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (II) ANY AMOUNT IN THE AGGREGATE IN EXCESS OF THE GREATER OF THE FEES PAID BY YOU UNDER THIS LICENSE, AND US$100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

(the "Sponsor") is offering the "Football for Good Sweepstakes" (the "Promotion") and will award one (1) Grand Prize via a random selection from eligible Entrants ("Entrants"). (D) With FREE Entry by Mail - Hand print your first/last name, e-mail address, street address, city, state/province, zip/postal code and phone number on a 3" x 5" card and mail in an envelope hand addressed to: Football for Good, PO Box 12487, Scottsdale, AZ 85267-2487, ("Mailed Entry"). Limit of one (1) Mailed Entry per envelope. Mailed Entries must be postmarked no later than March 31, 2012 and received by April 9, 2012.

There is a limit of one hundred (100) Installation Entries per person per e-mail address; however there is no limit to the number of Referral, Donation or Mailed Entries you can receive.

Any attempt by any Entrant to obtain more than the stated number of Entries by using multiple/different/duplicitous e-mail addresses, the use of multiple identities, registrations and logins, or any other methods will void that Entrant's Entries and that Entrant may be disqualified. Entries that are incomplete, contain irregular or invalid information, are late, lost, misdirected, illegible or are otherwise corrupted are void and will not be accepted. Entries become the property of Sponsor and will not be returned.

(4) Data Collection - All personal information from you that is collected by Sponsor will be used solely for the administration of the Promotion and in accordance with the Sponsor's Privacy Policy. By entering the Promotion, you agree to all of the terms and conditions of Sponsor's Privacy Policy, which is available at www.footballforgood.org.

(5) Grand Prize - One (1) Grand Prize Winner will receive his/her choice of one (1) of the following Prize Options: (A) A trip for two (2) people to Los Angeles, CA, to visit the set of the show, CSI:Miami ("Los Angeles Trip Option"), Approximate Retail Value ("ARV") not to exceed $2,500 USD. The Los Angeles Trip Option consists of round-trip coach airfare for two (2) people from the major metropolitan airport closest to the winner's home (as determined by the Sponsor) to Los Angeles, CA, three (3) nights standard hotel accommodation (based on double occupancy), a visit to a taping of the show, CSI: Miami, a cast-autographed script and a "meet & greet" with the show cast. The Los Angeles Trip Option is available on a schedule as determined by the Sponsor and the taping schedule of the show and cast and must be completed no later than March 31st, 2013.

(B) A one-time cash payment by check of $2,500 USD ("Cash Option").

The Los Angeles Prize Option does not include ground transportation to/from the departure airport nearest the winner's home, meals, tips, gratuities, accident, baggage or trip cancellation insurance, or personal expenses such as laundry and phone calls. Winner and traveling companion must travel on the same itinerary and winner's traveling companion must be 18 years of age or older or have reached the age of majority in his/her state, province or territory of residence. Sponsor reserves the right to substitute any portion of the Los Angeles Trip (including accommodations and/or any activity) with an item of comparable or greater value. In the event of unavailability of the Los Angeles Trip Option, the Sponsor reserves the right to award the prize as the Cash Option, described above. There is one (1) Grand Prize available with the total value of $2,500. The odds of winning depend upon the number of eligible Entries received at the end of the Promotion Period; i.e., if 1,000,000 Entries are received the odds of winning are 1:1,000,000

(6) Prize Awarding - The Grand Prize winner will be randomly selected in a drawing conducted on or about April 10, 2012. Potential Grand Prize winner will be contacted within three (3) business days of the drawing by phone and e-mail and will be required to satisfactorily complete and return an Affidavit of Eligibility and a Liability/Publicity Release ("Affidavit"), (unless prohibited by law). The Affidavit must be returned within five (5) days of provision of the document. In completing the Affidavit the potential winner will be required to provide his/her social security or tax identification number which will be used solely for the purposes of Sponsor's legal compliance in filing US Tax Form 1099. Potential winner will also be required to send a copy of his/her passport, driver's license, birth certificate or other appropriate documentation (acceptable to Sponsor) as proof of age and residency. Non-compliance with any of these requirements will result in disqualification, forfeiture of the prize and the selection of an alternate winner. Return of prize notification and/or Affidavit as undeliverable will result in disqualification, forfeiture of the prize and the selection of an alternate winner. Winner's traveling companion will be required to sign and return a Liability Release/Publicity Release/Proof of Age prior to travel. Sponsor has no obligation for compensation or reimbursement of any kind if the verified Grand Prize winner has accepted the Los Angeles Trip Option, travel arrangements have been booked/purchased and verified winner cannot take or complete the Los Angeles Trip for any reason. If the Grand Prize winner has selected the Los Angeles Trip Option and lives within a one hundred (100) mile radius of Los Angeles, CA the Sponsor reserves the right to substitute a $300 USD travel allowance in place of the airfare portion of the prize. In compliance with Canadian law, if a Canadian resident's entry is selected as the Grand Prize winning entry, the Entrant must correctly answer a multiple part mathematical skill question as a condition of being named a valid winner. If a Canadian resident is the verified winner of the Grand Prize, the prize will be awarded as a one-time cash payment by check of $2,500 less 30% Federal U.S. tax which the Sponsor will remit to the U.S. IRS in compliance with U.S. tax law.

Entrants grant Sponsor the right to use and publish winner's proper name and State /Province of residence online in connection with the Promotion. Acceptance of a prize constitutes permission for Sponsor to use winner's name and likeness solely for advertising and promotional purposes as Sponsor so determines without notice or further compensation, except where prohibited by law. Prize recipient shall not be permitted to (a) replace his/her designated prize with another prize or item (b) redeem the prize for cash or (c) transfer or assign his/her designated prize to another person. All federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner.

(7) General - This Promotion is void where prohibited or restricted by law, and is subject to all applicable federal, state and local laws. By participating in the Promotion, Participants agree: (a) to be bound by these Official Rules and the decisions of the Sponsor, which shall be binding and final, without right of appeal, with respect to any and all matters relating to the Promotion, including without limitation, as to eligibility and/or disqualification of Entries; and (b) to waive any right to claim ambiguity in the Promotion or these Official Rules except where prohibited by law; and (c) releases the Sponsor, its advertising and promotional agencies and each of their respective officers, directors, agents, representatives, successors and assigns from any and all liability in connection with this Promotion, the Entrant's participating therein and/or the awarding and use/misuse of the prize.

Sponsor is not responsible for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software, or web site. Sponsor is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information, howsoever caused, or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any, aspect of this Promotion, including without limitation using bots, scripts or other mechanisms to automate the receipt of Entries as solely determined by the Sponsor and/or its Promotion Administrator will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate Entrant's eligibility to participate in the Promotion. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award prizes at random from among the eligible Entries received up to the time of the impairment.

(8) Choice of Law and Dispute Resolution - This Promotion is governed by the laws of the United States and the State of California applicable to contracts made and performed in the State of California, without respect to conflict of law doctrines. As a condition of participating in this Promotion, participants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of California; and (2) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SPONSOR'S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THIS PROMOTION, WHETHER IN CONTRACT OR TORT OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE STATED ARV OF THE PRIZES OFFERED HEREUNDER. In the event any provision of these Official Rules will be held to be unenforceable, these Official Rules will continue in full force and effect without such provision. These Official Rules are intended to be the complete, final and exclusive statement of the terms of the agreement between each Entrant and the Sponsor relating to the subject matter hereof.
